A judge at the federal courthouse in Portland Friday denied bail to five of the militants arrested near Burns earlier this week in connection with the armed occupation at the Malheur National Wildlife Refuge.

Though only five were detained, all of the militants who appeared in court will remain in custody through at least Tuesday.

Judge Stacie Beckerman denied bail to both Ammon and Ryan Bundy, saying both defendants are a flight risk and a danger to the community. Beckerman also denied bail for Ryan Payne.

“In many respects, Mr. (Ammon) Bundy would appear an ideal candidate for release,” U.S. Attorney Ethan Knight told the court Friday.

But after “peeling back the layers,” Knight said Bundy is a flight risk and dangerous. He said Bundy was the leader of a conspiracy that involved the use of intimidation and force.

“He is simply not a viable candidate for release, looking at either his risk to the community or danger of flight,” Knight told the court.

One of Ammon Bundy’s lawyers, Lissa Casey, argued the occupation wasn’t a violent attempt to overthrow the government.

“We don’t agree with the prosecution that he is a danger,” said Casey.

She said that Bundy wants to return to his Idaho home.

“He doesn’t even own a passport,” she said. “The only place Mr. Bundy wants to be is home with his wife and children.”

Bundy’s lawyers tried to distance him from the ongoing occupation at the refuge, where four armed militants remain in an at times tense standoff with the FBI. Casey said when she told Bundy about holdout David Fry, he said he didn’t know who that was.

Over the past two days, Bundy has also issued statements through his lawyers asking the remaining militants to leave the refuge.

“I have asked those people at the refuge to go home,” Bundy told the court. “This was never about an armed standoff.”

Ultimately, Judge Beckerman was not convinced.  She said Bundy and the occupiers knowingly broke the law and only left the Malheur Refuge after they were arrested.

“There are no conditions I could impose that would guarantee the safety of the community or that he would come back to the district of Oregon for trial,” Beckerman said. “I reject the argument that this was just a peaceful occupation.”

After the ruling, Bundy stood up. While walking toward the door leading back to detention, he looked over his shoulder to his wife, Lisa Bundy, in the second row, her eyes filled with tears.

After eight arrests and one death Tuesday night, FBI officials established checkpoints around the Malheur National Wildlife Refuge early Wednesday morning and later held a press conference.
Ammon’s brother, Ryan Bundy was equally unsuccessful in securing a pre-trial release.

“It would be impossible for anyone – including your honor – to get on that refuge right now,” said Andrew Bates, the criminal defense attorney representing Ryan Bundy.

FBI agents in Harney County have blocked the roads in and out of the refuge.

Bates argued Ryan Bundy, a father of eight, has lived most of his life within a 100-mile radius and has little criminal history.

“The only violence in this entire case has been perpetrated by the government,” Bates said, before bringing up deceased militant spokesman LaVoy Finicum. “You’re right someone died — at the hands of the police.”

In addition to Payne and the Bundy brothers, Beckerman also denied bail for Dylan “Captain Moroni” Anderson and Jason Patrick.

The judge granted bail to defendants Joseph O’Shaughnessy and Shawna Cox, but federal prosecutors appealed the decision. As a result, a ruling in their hearings has been stayed until Tuesday. 

Beckerman made no decision by the close of court for conservative Ohio radio host Pete Santilli, who spent much of the occupation being a mouthpiece for the militants and hosting an online radio show – some of which prosecutors are using as evidence against the defendants.

The judge said she needed more time to review his case.

Two other militants, Brian “Booda” Cavalier and Oregon resident Duane Ehmer, did not have detention hearings Friday because they had not met with their attorneys yet.

At their initial court appearances earlier this week, most of the militants’ defense lawyers asked that their clients be released from detention.

A preliminary hearing is scheduled for next Wednesday, where federal prosecutors will lay out their case against the armed occupiers.

The Democrats are right, there are two Americas. The America that works and the America that doesn't. The America that contributes and the America that doesn't. It's not the haves and the have nots, it's the dos and the don'ts. Some people do their duty as Americans, obey the law, support themselves, contribute to society and others don't. That's the divide in America . 
It's not about income inequality, it's about civic irresponsibility. It's about a political party that preaches hatred, greed and victimization in order to win elective office. It's about a political party that loves power more than it loves its country.
That's not invective, that's truth, and it's about time someone said it.
The politics of envy was on proud display a couple weeks ago when President Obama pledged the rest of his term to fighting "income inequality." He noted that some people make more than other people, that some people have higher incomes than others, and he says that's not just. That is the rationale of thievery.
The other guy has it, you want it, Obama will take it for you. Vote Democrat. That is the philosophy that produced Detroit.
It is the electoral philosophy that is destroying America. It conceals a fundamental deviation from American values and common sense because it ends up not benefiting the people who support it, but a betrayal. 
The Democrats have not empowered their followers, they have enslaved them in a culture of dependence and entitlement, of victim-hood and anger instead of ability and hope. The president's premise – that you reduce income inequality by debasing the successful–seeks to deny the successful the consequences of their choices and spare the unsuccessful the consequences of their choices. Because, by and large, income variations in society are a result of different choices leading to different consequences.
Those who choose wisely and responsibly have a far greater likelihood of success, while those who choose foolishly and irresponsibly have a far greater likelihood of failure.
Success and failure usually manifest themselves in personal and family income. You choose to drop out of high school or to skip college – and you are apt to have a different outcome than someone who gets a diploma and pushes on with purposeful education.
You have your children out of wedlock and life is apt to take one course; you have them within a marriage and life is apt to take another course. Most often in life our destination is determined by the course we take.
My doctor, for example, makes far more than I do. There is significant income inequality between us. Our lives have had an inequality of outcome, but, our lives also have had an inequality of effort. While my doctor went to college and then devoted his young adulthood to medical school and residency, I got a job in a restaurant. He made a choice, I made a choice, and our choices led us to different outcomes. His outcome pays a lot better than mine. Does that mean he cheated and Barack Obama needs to take away his wealth? No, it means we are both free men in a free society where free choices lead to different outcomes.
It is not inequality Barack Obama intends to take away, it is freedom. The freedom to succeed, and the freedom to fail. There is no true option for success if there is no true option for failure. The pursuit of happiness means a whole lot less when you face the punitive hand of government if your pursuit brings you more happiness than the other guy. Even if the other guy sat on his arse and did nothing. Even if the other guy made a lifetime's worth of asinine and short sighted decisions.
Barack Obama and the Democrats preach equality of outcome as a right, while completely ignoring inequality of effort.

The simple Law of the Harvest – as ye sow, so shall ye reap – is sometimes applied as, "The harder you work, the more you get."
Obama would turn that upside down. Those who achieve are to be punished as enemies of society and those who fail are to be rewarded as wards of society. Entitlement will replace effort as the key to upward mobility in American society if Barack Obama gets his way. He seeks a lowest common denominator society in which the government besieges the successful and productive to foster equality through mediocrity. He and his party speak of two Americas, and their grip on power is based on using the votes of one to sap the productivity of the other. America is not divided by the differences in our outcomes, it is divided by the differences in our efforts.
It is a false philosophy to say one man's success comes about unavoidably as the result of another man's victimization.
What Obama offered was not a solution, but a separatism. He fomented division and strife, pitted one set of Americans against another for his own political benefit. That's what socialists offer. Marxist class warfare wrapped up with a bow. Two Americas, coming closer each day to proving the truth to Lincoln's maxim that a house divided against itself cannot stand.

There are times when you have to report a story and whatever you say will be wrong, no matter how hard you try to be objective. There will be those in the court of public opinion who will try and make it their crusade to malign you when you are attempting to report uncomfortable information.
The last time this happened to me and my staff was during the Sandy Hook shootings. There were mixed reactions to my reporting of that case and since we live in time where the extended middle of a story becomes a nuisance to those who make deaths of people a political football.
The court of public opinion has been encouraged to do so. It is an indicator that the police state mentality, which I conclude is a consensus state of mind where due process is selective, has its staunch supporters.
There seems to be a hidden agenda in our country where the media both independent and mainstream is trying to see who can create the most outrage by pandering to both political ideologies and exploiting their bias and prejudice in such a way that it will eventually reach its breaking point.
It can be predicted that incidents such as the Oregon standoff will multiply and when they do those who normally support civil liberties will call upon the government to use deadly force in all instances of revolt.
For example, those who call themselves progressives cheered on the use of deadly force against Ammon Bundy and the other ranchers who supported his cause.
These same progressives have screamed out against police brutality and excessive use of force during the times of Ferguson and Baltimore.
Conservatives properly fight against gun control laws and tyranny, except when they call upon the police state to do something about both Latino and Syrian immigration. Both sides need the police state in order to eliminate those they don’t agree with.
This guarantees what Orwell once said is the Jackboot stomping on one’s face forever.
No one no matter where he lives, whatever his job is, religious affiliation, or even political affiliation – we’ll know who will be under the gun next in a future police state, where the police will continue be like military units and foreign practices will be honored as the United Nations troops will be consulted to police areas where other insurrections will take place.
Situations like the Oregon standoff will eventually become ordinary as the failure of recognizing constitutional law will allow for American citizens to speculate that it has become a suicidal proposition, and will be supplanted by technocratic policies used to justify expanding the leviathan worldwide government.
There will be more Americans that will attempt to resist government policies, with some turning to organized violent activities. The response will be brutal, and the government will be encouraged to become more authoritarian by some its own people for political reasons – this will invite more uprisings and insurrection from people who you wouldn’t even expect to participate.
The Oregon standoff was never a Lexington and Concord nor was it a Fort Sumter. It was a symptom of some serious issues this country has on a political level.
The biggest example of this is how objectivity and lack of available of information has created a massive hate campaign against anyone who has trampled on someone else’s normalcy bias.
From the very beginning of the standoff, I had the horrible job of being critical of the Bundys and inviting Stewart Rhodes from the Oath Keepers and Chris McIntire of the Idaho 3% on to the show. Both are known militia groups and both saying he didn’t support the takeover of the wildlife refuge and predicted how Ammon Bundy’s offensive attack would play out.
I was called an armchair warrior, a coward and a shill for having them on the show and even though there was harsh criticism about their stand, the truth is they were right about what would happen.
I was also being told that for all of the things I have said about standing up against tyranny, my critical views made me less of a patriot. I guess you have to support a standoff that obviously was haphazardly organized, ill-conceived with no real defined goals, instigated without one bit of concern for the fact they threw down the gauntlet, basically sending the message they wanted a fight.
No cause, no real plan, and no intended goals which is the worst possible way to launch a fight against federal corruption. I spent 5 hours saying as much and at the same time, thinking that when the worst comes to Bundy and his insurgent cowboy crew, I will still be wrong with an objective and critical assessment.
If you sympathize with Bundy and his crew you are a terrorist sympathizer. If you sympathize and still think his plans were flawed you are a coward and not a true patriot.
Well, I committed the horrible sin of both sympathizing to a certain degree the idea of standing up to the BLM, and at the same time agreeing with Stewart Rhodes and Chris McIntire. It was a dangerous plan and I believe they were lucky that more didn’t die in the end.
Strategic errors get people killed; this is the case for both the F.B.I and the Bundy crew.
That is why LaVoy Finicum was shot and killed by police officers. This is why the armchair viewers in the court of public opinion will say “he went for his gun” while others will say that he lost his balance, doubled over from his first gunshot wound and was shot again.

Whether or not you say the police were correct, or that Finicum was brutally murdered with disproportionate force, he died as the eye witnesses say he did, with his arms raised.
For the progressives it was Michael Brown’s death that transformed the slogan “hands up, don’t shoot.”
Strangely, none of it applies to suspected criminal, LaVoy Finicum as comments are he deserved to die no matter if his hands and arms were raised or not. It appeared the political right said the same thing about Mike Brown; he was called a criminal too and yet became the darling of the media and another poster child for police brutality.
Does a life lost on the side of the road in rural Oregon matter? Not when it is a political football for progressives who see him as an example of domestic terrorism.
The words “terrorism” and “terrorist” are convenient political terms that are used only when it is convenient to force multiply an intense crisis or situation. What seems to be ignored here is that Bundy and his crew will be labeled terrorists which will cloud the issue of having them be nothing but cannon fodder for a nationwide government crackdown, which in turn will spark copycat events more organized, more advanced, more publicized and more divisively reported by the mainstream media.
Facts and the media no longer congruently connect. The public opinion is based on who controls the story, and this is why blurry footage taken from a plane of a man jumping out of a vehicle with his hands up, reaching down for either a gun or to keep his balance will be reported as an attempt to fire on officers.
This is why we know who controls the story, and who wants to control the court of public opinion.
That is why we will hear a story from a frightened Victoria Sharp on Ground Zero giving her version of the story from the vehicle that was stopped, and the police not wanting to comment on the situation for a balanced view.
Their version of the story is saved for the mainstream media. Their version of the story was not heard on my show; because they were too busy arresting Jason Patrick, a guest that was scheduled to appear on Ground Zero the night armored vehicles stormed the wildlife refuge.
The PIO was asked to comment. He didn’t. We wanted a balanced view, and that is why Daniel Lewis Crumpton stated that he did not agree with some of my views. It is interesting that even though I had Connie Bundy’s account and Victoria Sharp’s account of what happened, I was conveniently ignored when asked for a police assessment, and was blasted with e-mails telling me that I should eat crow, that I was wrong, and that it is obvious LaVoy Finicum pulled a gun.
With no sound, all the time codes on the video blocked out, and the blurry views from the plane above, I am told it was obvious that LaVoy Finicum deserved his death. With mainstream media reports of Finicum being on his knees or the reports of him lunging at officers, it was obvious, from the other reports that it was a routine traffic stop that resulted in a shoot out – far from being the truth it was obvious.
Is it really obvious? Is it truthfully clear as crystal? Or are we all snowblind?
What is obvious is who controls the information in this situation. It certainly isn’t me, and the ridicule that I and several others have received trying to report what the mainstream won’t is in my opinion self-defeating.
It is evident that a lot of people in this country emote, feel and believe the mainstream narrative, rather than think, reason and break out of the police state dialectic. It is also evident that people tend to want to figure out someone’s political beliefs before they support someone and listen to what they are truly saying.
It is programming that creates the hate filled e-mails, tweets and Facebook entries sent to those who choose to be messengers. It also demonstrates how easily people can be manipulated by having their prejudices confirmed in order to stir up darker and more enraged emotions.
This entire story indicates to me that we are all capable of biting a baited hook reflexively without taking the time to analyze, reflect, ponder, repeat the process and then critically draw conclusions.
There is no majority right or wrong analysis ruling in the case of the Bundy standoff, only a bullying minority that uses counter posturing to stroke and coddle their normalcy bias.
If you want to know the truth about why I can sympathize with these occupiers and still consider their actions flawed is that I feel the federal government has no right controlling lands of counties and states. It should only be that the federal government be able to push their statutory rules on federal possessions only.
I have always felt that the controls over the land and common law Americans are simply draconian and out of control, and no one cares enough to say something or do anything.
The problem is no one can even begin to understand what laws benefit them and what laws are there to create conflict and derision. The majority voluntarily gives consent to the corrupt leadership to educate them on such matters and so the media will water-down and obfuscate the issues most important to the public.
This is because all government ultimately depends on the consent of the governed. But we have somehow surrendered our decisions in matters of policy and have left it up to those we call our authorities.
Anyone who questions or does not give consent to their policies gets tagged. Some rebel, some have ill-conceived plans for insurrection, some are tased, some are hit with pepper spray and some are killed.
The rest of us consider ourselves as innocent bystanders, but how innocent are we really when we cheer on the deaths of anyone, including those we have been programmed into believing are armed militants or terrorists.
If terrorism has any reasonable definition, it is the use of violence against innocent non combative individuals for a political purpose. Terrorist acts are the killing and or injuring noncombatant individuals, or destroying their property, in an effort to effect political change.
Does this definition fit the Bundy brigade?
I guess your opinion is yours, but I would say that a blurry line exists and the authorities are going to do their best to un-blur it for their agenda.
In the video that has been provided we see the flash bombs, and a man falling to his death after allegedly reaching for a gun – that appears to be the only violence that took place in this whole ordeal.
LaVoy Finicum appearing to reach for his gun seems to be the worst of allegations. They are allegations against a citizen who many agree broke the law. However, can we also make the allegation that at the government is out to make an example of these occupiers? The government does not tolerate the resistance of rural ranchers and farmers to the aggressive tactics of the government and the radical “environmentalist” movement, which obviously aims at eliminating the few private landowners that remain in defiance of the rules of sustainability.
How are the ranchers and farmers going to sustain themselves when their lands are taken over for mining and the growing of genetically modified crops?
What power do they have when the BLM revokes their permits, block water usage and does everything they can to force them off their land?
These ranchers and farmers provide us with our food, and it appears that the government is in the business of scarcity.
When the media decides to label them militants or terrorists, they have already given them a death sentence in the court of public opinion and this is why there is cheering and support for the authorities and what happened to LaVoy Finicum.
That to me, is as clear as crystal.

What follows is my personal account of following the situation of late Tuesday night and into Wednesday morning, including talks with sources on the ground and on conference calls with Sergeant Major Joseph Santoro (U.S.A., Ret.), Stewart Rhodes, State Representative Matthew Shea (R-WA), Jason Van Tatenhove, and others.  Much of the following information has been poorly covered by the media or not reported at all.
After the felony stop, Sergeant Major Joseph Santoro (U.S.A., Ret.), who has been on the ground in Burns for approximately three weeks, began communicating with FBI contacts. A top priority for SGM Santoro, acting in coordination with Pacific Patriots Network, Oath Keepers National, Stewart Rhodes, State Representative Matthew Shea (R-WA) from the Coalition of Western States (C.O.W.S.) and a Coalition representative at the Refuge, was to work with the FBI in order to give enough time for women and children at the Refuge to leave. He repeatedly expressed his concern that an FBI action on the compound would result in further loss of life, including the potential for harm to women and children. SGM Santoro convinced his FBI contacts to delay any action on the Refuge, while a C.O.W.S. representative at the Refuge worked to get the women and children packed up to leave. Through numerous phone calls and face to face coaxing, a majority of the occupiers agreed to leave. Additionally, a YouTube video posted by David Fry early Thursday morning confirms that conditions at the Refuge were 'chaotic' as occupiers packed up to leave as quickly as possible.
The stated mission of the Pacific Patriots Network and Oath Keepers has been to prevent another Waco scenario, where federal agents mass murder American citizens during an assault on a compound.  That mission has so far been accomplished.
According to sources at the Refuge, there weren't enough vehicles to transport everyone who wanted to leave the Refuge. SGM Santoro relayed that to the FBI, and the FBI contacts instructed those without a vehicle to drive a Bureau of Land Management (BLM) vehicle parked at the Refuge into Burns and park it at a location where it would later be picked up by BLM officials.
According to sources at the Refuge, Jason Patrick, who decided to stay, became angry that most occupiers were leaving, and refused to move a vehicle so that they could leave the Refuge Headquarters. Those leaving were forced to drive through private property in order get back to a highway, where they began their trip back into Burns, and then home.
At approximately 0200L on the morning of 27 January, sources in contact with the FBI claimed that the remaining occupiers were given until 0400L to vacate, implying that action might be taken to remove them if they stayed past the deadline. At 0400L, no action was taken, and as of 1900L on Friday, 29 January, no direct action has been taken at the Refuge.
On Wednesday afternoon, Duane Ehmer, the cowboy who infamously rode his horse while hoisting an American flag, was arrested by the FBI.
On Wednesday evening, negotiations with Jason Patrick were finally successful and he agreed to leave the refuge. According to sources familiar with the story, the FBI told Jason Patrick that he was free to leave. After walking seven miles out of the Refuge to the FBI checkpoint to be picked up and carried into Burns by PPN personnel, he was arrested by law enforcement at 1910L due to an outstanding warrant. (Analyst Comment: Jason Patrick was damned if he did and damned if he didn't. Being one of the more ardent protesters at the Refuge, the FBI likely considered him to be one of the top instigators, especially after he decided to stay as most others left.  Still, according to sources, the FBI told Jason Patrick that he was free to go, after which Jason decided to leave only to be arrested by law enforcement and taken into federal custody.  Because the FBI said Jason was free to leave and have not made good on their promise to him, the FBI has further tarnished their credibility with the occupiers, the Pacific Patriots Network, and the people of Harney County.  Furthermore, this event may be another reason why the remaining four occupiers have not taken up FBI offers to vacate.)

The following portion of the SITREP covers unfolding events at the Malehur National Wildlife Refuge and in the vicinity of (IVO) Burns, OR over the past 24 hours.
As of 1800L on Thursday, 29 January, four protesters remain at the Malheur National Wildlife Refuge.  David Fry, the author of the YouTube channel DefendYourBase has been uploading videos and intermittently live-streaming the occupation since early Wednesday morning.  Despite calls from Ammon Bundy to leave the Refuge, which were iterated through his attorneys, David Fry recently stated that he was going to remain "to the end."
Sources familiar with the ongoing situation say that FBI agents have been in contact with Fry since Wednesday, attempting to negotiate their departure.  At one point, multiple occupiers had negotiated to walk away, however, they later decided to remain.  Fry is also speaking with media by cell phone on their continued occupation.
– There are efforts underway to organize large gatherings in Burns and Eugene, Oregon to protest the killing of LaVoy Finicum in front of the governor's office and another building.  Follow the Pacific Patriots Network for additional and up to date information.

The tragedy of Tuesday’s Oregon Malheur refuge affair is that like most other Americans,  the occupiers mistakenly assume they still have freedom of movement in today’s America.
They didn’t and don’t.  And now a dead cowboy,  barely mentioned in the Fox/Trump mainstream media saturation coverage,  is the tragic result.
The shooting which claimed the life of rancher LaVoy Finicum, father of 11 children and numerous grandchildren, is already being written off as a routine “traffic stop”.

“The occupation of a federal wildlife refuge near Burns, Ore., took a violent turn on Jan. 26 when a shooting unfolded during a traffic stop. One member of the armed group was killed and eight were arrested, including leaders Ammon and Ryan Bundy. (The Washington Post, Jan. 27, 2016)
“After an exchange of gunfire Tuesday that left one man dead and another injured, the two brothers who orchestrated the armed occupation of a remote central Oregon wildlife refuge were taken into custody while traveling outside the area, along with six of their followers.
“Then, early Wednesday the government shut down the area, initiating what authorities called a “containment” with checkpoints and promising to arrest any unauthorized people attempting to travel into the refuge.
“The purpose, according to a statement from the FBI and Oregon State Police was “to better ensure the safety of community members and law enforcement.” Earlier, they had asked people to leave the area, but there was little sign that the remaining occupiers had done so, setting up the possibility of police action later in the day.”
Authorities on the scene long before the occupiers started out on their 100-mile trip to attend a community meeting in John Day, Ore., before being ordered to stop by the FBI and Oregon State Police about halfway to their destination,  had everything on their side—timing, firearms, ammunition and the last word.
Lying in wait for the ranchers on the highway, they had been waiting for them to make their first wrong move.  It came at 4:25 p.m., local time on Tuesday, January 26.
Some are saying that Mr. Finicum had his hands up when he was shot down—but authorities now own the narrative of the circumstances of his last moments on earth too.
The tears, not of Sheriff Ward, who only yesterday pleaded with them to give up, but of the dead cowboy’s children and grandchildren will be the ones longest remembered.
As long as government agencies take away the land of generation old farms and ranches, as long as they accuse their owners of owing steep fines for cattle wandering off paths to graze on GOVERNMENT grass, there will be ‘dissidents’ fighting for their rights.
Even in a world where the government can take your children, your land, tax or fine you out of livelihood,  seize your bank accounts, your property, impose the laws of eminent domain and tell you where you can and cannot pray; the common man, reading his Bible,  will still go on hoping and searching for better days.
It’s somehow wired into the human DNA of down-and-out people to stick together against all odds;  for ranchers who see a brother, twice jailed for the same government-charged crime of burning his land as an injustice worth rallying for.
But huge tracts of the land really no longer belong to the farmer or rancher anymore.  It belongs to the government, which has been known to enlist the most determined of environmentalists to get out and reclaim it.
There was a time when just like the local post office, town hall, board of education buildings, the Malheur National Wildlife Refuge was considered the possession of the taxpayers.  Nowadays public buildings may be maintained by tax payer dollars but are never, in any way, their rightful property.
It’s tragic that average citizens have to take into consideration that their own government might kill them.  But, in fact, thinking that way gets them killed, even if it’s one at a time.
Jason Patrick, who still remained at the Malheur refuge on Tuesday night, told The Post by phone,  “Right now, we’re doing fine.  We’re just trying to figure out how a dead cowboy equals peaceful resolution.” (Update: Jason Patrick was arrested last night)
Most tragically of all in Tuesday’s shooting of Mr. Finicum is not that one more cowboy has been shot down, it’s that society is allowing the curtain to come down on the cowboy as America’s most legendary icon.
Rest in peace LaVoy Finicum, you did something no BLM agent is likely to ever do, you died with your boots on.

Eyewitness Says Feds Ambushed Bundys, 100 Shots Fired at Passengers, Lavoy Finicum Killed With ‘Hands Up’

Last night, the standoff at Malheur National Wildlife Refuge outside Burns, Oregon took a rather ugly turn which resulted in one man shot dead and another wounded by federal agents.
The latest incident took place as two vehicles carrying protesters, led by Ammon Bundy, were en route to a community meeting in the nearby town of John Day in Oregon.
According to numerous mainstream media reports and local media outlet Oregon Live, ‘federal sources’ are telling the media that only “3 shots were fired”, but a new eye witness testimony by one of the vehicle’s passengers tells a very different story.
While the mainstream media is still referring to the event as “a shoot-out”, according to this latest eye witness account at the scene – no shots were fired by vehicle passengers.
According to eyewitness Victoria Sharp, 18 yrs old from Lakeside, Montana, who was in the same truck with Arizona rancher Lavoy Finicum, Ryan Bundy, Ryan Payne and Shawna Cox, dozens of federal vehicles and countless agents were waiting for the group, pre-positioned at a point along on the isolated rural Highway 395, before intercepting the group and making 8 arrests, and eventually holding only 5 persons including Ammon and Ryan Bundy – were booked into Multnomah County Jail early this morning.
Sharp confirmed that the passengers never drew weapons and attempted to get out of their vehicles before federal agents fired “at least 120 shots altogether” at the vehicle carrying her party, but not the other vehicle, a Jeep with Ammon Bundy inside, driven by private security Mark McConnell.
Federal agents fired their first shots at passenger Ryan Payne – as he attempted to make contact with the agents by sticking his head and hands out of the window, at which point Payne got back inside the vehicle.
Payne then exited the truck and was detained before driver Finicum advanced the vehicle further down the road before sliding into a snow bank on the side of the road.
After crashing into the snow bank on the side of the highway, driver Lavoy Finicum (photo, above) then exited the vehicle, was visibly upset and with his hands in the air, before being gunned down by federal agents. Finicum was walking with his hands in the air, daring federal agents, “Just shoot me! Just shoot me” – at which point the agents shot him dead. His hands were still in the air.

Numerous ‘red dots’ from lasers could be seen pointed on the passengers by federal marksmen, in what was described by this witness as an “ambush” by federal authorities. Sharps said, “I had 20 lasers on me when I got out of the car.”
She also confirmed that Ryan Bundy was shot and wounded in the arm by federal agents while still inside the truck.
At least 40 vehicles, as well as many armed federal agents were seen emerging from the surrounding forest along the highway leaving little doubt as to the scale of the operation.
According to local media reports: “The  highway was blocked for a 40-mile stretch between Burns and John Day. Police were stationed near Seneca, a small city of 200 south of John Day, with long guns. They said they didn’t know how long the roadblock would be place. Grant County Sheriff Glenn Palmer was there.”

Conflicting Accounts
Reporter Les Zaitz from Oregon Live, a key source of mainstream media information from the Refuge protest, did not give prominence to Victoria Sharp’s account in his article, but instead chose to lead with and highlight the secondhand account of the other vehicle’s passenger Mark McConnell who claimed that unarmed victim Lavoy Finicum “charged at law enforcement” before being shot. Zaitz’s article even admits that McConnell’s vehicle was at least 200 yards behind the truck driven by Finicum.
Incredibly, Oregonian Zaitz appears to favor McConnell’s account on the basis that his account has “matched accounts from law enforcement sources.” McConnell issued his version of events after being released law enforcement custody, where he spoke for 2 hours with law enforcement officers and agents.
Website Raw Story also ran with a similar narrative with a deceptive headline that read “Eyewitnesses knock down conspiracy theories about LaVoy Finicum…“, referring to secondhand accounts by McConnell and fellow passenger Melvin Lee.
As it turns out, Mark McConnell did not actually see the shooting, and instead had ‘pieced together’ his account, as evidenced by his own statement later posted online:
…”going off of what Shawna Cox and Ryan Payne were saying, which were in the vehicle, um, Visually, I seen the truck take off, you know, now any time someone takes off in a vehicle away from law enforcement after they exercise a stop, it’s typically considered an act of aggression and foolish. Payne said while they were sitting there and they were clearing my vehicle that him and LeVoy had a heated discussion…”
“…but he took off they had to chase him, and from what Shawna Cox was saying… from inside of his truck that when he exited the vehicle… he charged after law enforcement….”
“What I do know to be true, from what Payne said and what Shawna said taken pieces here and pieces there and from what I witnessed, um, I didn’t see the shooting, um, he was not on his knees, he was not, none of that non sense, that was a miscommunication on somebody elses part but he went after em, he charged em.”
Amazing, after speculating about the shooting, McConnell then says, “… I didn’t see it, and I’m not going to speculate on it.”
McConnell is said to have been riding in the rear vehicle with Ammon Bundy and his private security, Brian Cavalier.
This shocking turn of events comes just days after Oregon governor Kate Brown issued what some might consider to be a veiled threat to the protesters and militia, saying that the federal government “must move quickly to end the occupation and hold all of the wrongdoers accountable.”

According to the FBI’s press release, arrested individuals include:
Ammon Edward Bundy, 40, of Emmett, Idaho
Ryan C. Bundy, 43, of Bunkerville, Nevada
Brian Cavalier, 44, of Bunkerville, Nevada
Shawna Cox, 59, of Kanab, Utah
Ryan Waylen Payne, 32, of Anaconda, Montana
Joseph Donald O’Shaughnessy, 45, of Cottonwood, Arizona

After the federal operation on Highway 395, in a separate incident back at the Wildlife Refuge, YouTube and internet radio personality, Peter Santilli, 50, of Cincinnati, Ohio, approached the venue and walked towards federal agents before being taken into custody.

Those still in detention are scheduled to be arraigned at 1:30 p.m. Tuesday in U.S. District Court in Portland.
According to reports, the FBI also “made a probable cause arrest of Jon Eric Ritzheimer, age 32, on a federal charge related to the armed occupation of the Malheur National Wildlife Refuge in Harney County, Oregon.”
Jon Ritzheimer, another controversial YouTube personality and former US Marine, appears to have left the protest just before the federal operation to apprehend the protesters, as he returned to his home in Peoria, Arizona.
Back at the Refuge protest site, the FBI are said to be negotiating with remaining 8-10 occupiers inside, with reports that most women and minors have already left the site.
